Terms of Service

1. Service description
BayRingAI is an AI phone receptionist service for small businesses. When a customer of a participating business dials a phone number provisioned through the service, our AI agent answers the call, gathers information, and (where appropriate) books an appointment on the business's calendar. After a successful booking, the service may send a single SMS confirmation to the caller.
2. SMS Program Terms
The following section describes the SMS portion of the BayRingAI service. It is required for compliance with US carrier messaging regulations (A2P 10DLC) and forms the full terms of the messaging program — please read it before opting in.

- Description
- SMS messages are sent after a customer calls a business using BayRingAI's AI receptionist service and successfully books an appointment through the call. Messages contain the appointment date, time, business name, and a way to reach the business if the customer needs to reschedule. The program is strictly transactional — no marketing, no promotional, no recurring messages outside of bookings.
- Frequency
- Approximately one (1) message per booked appointment. If a customer does not book an appointment, no SMS is sent. There are no recurring or scheduled messages beyond per-booking confirmations.
- Message and data rates
- Message and data rates may apply. BayRingAI does not bill for SMS, but standard messaging charges from your wireless carrier may apply. Check with your carrier for details.
- Help instructions
- Reply HELP for help. Replying HELP from the receiving phone number returns program identification and the support email below. You can also email support directly at any time.
- Opt-out instructions
- Reply STOP to opt out. Replying STOP from the receiving phone number will immediately and permanently unsubscribe that number from any further messages in this program. You can re-subscribe at any time by completing the opt-in form on bayringai.com or by booking another appointment through the AI agent and verbally confirming consent.

How to opt in: Customers can opt in to the program in two ways:
- By entering their phone number into the consent form on bayringai.com and checking the "I agree to receive SMS messages" box.
- By verbally confirming during a call when the AI agent asks "is the number you're calling from the best one to reach you on?" A "yes" response is recorded consent and the call recording is retained as documentation. A customer who provides a different callback number is consenting to receive the confirmation at THAT number.
3. Acceptable use
You agree not to use the BayRingAI service to:
- Harass, threaten, defraud, or otherwise abuse the agent or the businesses it represents.
- Transmit unlawful, infringing, or otherwise prohibited content.
- Attempt to circumvent the service's recording disclosure, rate limits, or other protections.
- Spoof caller-ID or attempt to impersonate another person when calling.
4. No professional advice
The AI agent is a tool to schedule service appointments. It is not a substitute for emergency services. If you have an emergency (fire, gas, medical), hang up and dial 911. The agent may offer to transfer urgent calls to a human, but you should not rely on that as your sole emergency route.
5. Service availability
We aim for high availability but do not guarantee uninterrupted service. BayRingAI depends on third-party providers (telephony, speech-to-text, large language models, calendar APIs) and may be affected by their availability.
6. Disclaimer
The service is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the AI agent will correctly handle every call or successfully book every requested appointment.
7. Limitation of liability
To the maximum extent permitted by law, BayRingAI's total liability for any claim arising out of or relating to the service is limited to the amount paid for the service in the twelve (12) months preceding the claim.
8. Governing law
These terms are governed by the laws of the State of Wisconsin, USA, without regard to conflict-of-laws principles.
9. Changes to these terms
We may update these terms from time to time. The current version will always be available at bayringai.com/terms with a "Last updated" date. Material changes will be noted in any communication tied to a booked appointment.
